Protesting Versus Rioting

I have written several articles Racism and Slavery. A list of links have been provided at bottom of this article for your convenience. This article will, however address different aspects on Racism and Slavery.

The 1st Amendment gives us the right to freedom of speech, religious expression, and the press, the amendment prohibits Congress from prohibiting the right of the people peaceably assemble and to petition the Government for a redress of grievances, ie the right to protest “peaceably“. A couple of Court cases have along since the Constitution to help clarify the rights of protesters. In 1969 Shuttlesworth v. Birmingham set certain limits, requiring licensing for free expression in public places, has to be narrowly defined and objectively applied. In 1989 Ward v. Rock Against Racism held that noise-related restrictions are constitutional as long as restrictions are content neutral. So cities and states can limit time , place and manner in which the protesters can assemble for reasons such as public safety and order.

So the states could have restricted the protesters to areas not so sensitive to damage and destruction. They could have totally eliminated the destruction of property completely with just a little common sense and direction. As soon as they saw what was happening to these “peaceful” assemblies they could have effectively put a stop to the wanton destruction with little police intervention. They could have had them assemble outside the city in open fields like they did for Woodstock for example. They could have also limited the time they were held and the duration of the protest.

But even if they did not do any of these things, it was incumbent on the leaders to protect the public and private property of these cities. They should have brought in the National Guard as soon as they realized that the local police were not going to be able to control the rioting. The one thing that they should have absolutely not done is to allow the rioters to take over the 3rd precinct police station in Minneapolis, this showed the rioters that the mayors and governors did not have the fortitude to protect there cities. I firmly believe that single act led to the escalation of rioting throughout the countries’ major cities and billions of dollars in damages that resulted. It is hoped that When it comes time to re-elect these officials that they are all voted out. Though what should happen is that they should be removed from official for gross dereliction of duty and incompetence.

As I have shown above there is no place for rioting in peaceful protesting. This rioting was strictly for profit and gain, and quite possibly for other reasons, which will hopefully be determined in time.
